ACLU: Police request cellphone records without warrants

Virtually all of the 200 law enforcement agencies that responded to public records requests filed by the ACLU track cellphones without warrants, with several falling far short of probable cause, according to a new report.?

The report comes as the intersection between technology and privacy reaches a crescendo. Concerns over Google's new privacy policy, recent tracking software and Facebook's Timeline are making many Americans squirm over the invasiveness of the sites and devices that define our lives. It's apparent law enforcement -- usually in the pursuit of ?investigations, mind you -- can and will find out who you are and where you are if they need to, as anyone who watches any TV crime procedural knows is par for the course.

It's been about a year since the last major dustup over cellphones and privacy, when surreptitious location tracking on mobile devices stirred Congress into action, prompting even Steve Jobs to respond to the allegations.

More recently, the presence of the Carrier IQ tracking software on many cellphones has sounded panic bells among privacy advocates, leading to a proposed cellphone privacy bill. The ACLU filed nearly 400 requests under freedom of information laws in the fall asking state and local agencies about "policies, procedures and practices for tracking cellphones."

In a statement, the ACLU said:

The responses varied widely, and many agencies did not respond at all. The documents included statements of policy, memos, police requests to cell phone companies (sometimes in the form of a subpoena or warrant), and invoices and manuals from cell phone companies explaining their procedures and prices for turning over location data.

But, the report shows the vast majority of the agencies from 20 states responded that they did engage in some kind of cellphone tracking, with New Jersey and North Carolina responding with the most instances. Only 10 agencies reported that they did not track cellphones.

In?Chatham County, North Carolina, law enforcement practices "real-time GPS tracking of cell phone on 'reasonable suspicion' standard," including other numbers tied to their targets.?

Catherine Crump, staff attorney for the ACLU Speech, Privacy and Technology Project, told msnbc.com of some of the more egregious findings:

We discovered that police in Cary, N.C. requested from Sprint a list of all phones that had used a particular tower -- meaning they were obtaining sensitive information about many people they had no reason to suspect were involved in a crime. ?We also discovered that several agencies deliberately try to keep secret the fact that they engage in cell phone tracking. An Iowa City police training manual instructs officers, "Do not mention to the public or the media the use of cellphone technology or equipment used to locate the targeted subject," and also advises officers to keep that information out of police reports. ?Finally, some police departments find this information so valuable that they have purchased their own cell phone tracking equipment. ?Police in Gilbert, AZ, for example, spent $244,000 on cell phone tracking equipment.

At the opposite end of the spectrum are the officers in Lexington, Kentucky: "In regard to the acquisition of cell phone location records, data, and/or information, such?items can be obtained only with a search warrant."

While the ACLU found "most law enforcement agencies that responded engage in cell phone tracking for investigative purposes," other agencies tracked the devices for other purposes, such as locating missing persons.

The report also found how compliant major carriers were to law enforcement requests, and how "there are hundreds of invoices from mobile carriers to law enforcement agencies that contain pricing data."

One example from Tuscon, Arizona shows "T-Mobile charges $150 for one hour's worth of data about what phones were?near one particular tower," while other documents uncover charges of $30 to $60 from Verizon Wireless for "15 minutes worth of tower data."

Documents from local law enforcement, such as the Bellevue Police Department near Seattle, reveal requests to carriers made through "911 Exigent Circumstances" form that covers suicide attempts, missing pesons, assaults and other instances where "one or more people face immediate danger of death or serious bodily injury." While they can request historical information -- and some departments do -- in Bellevue at least they stick to current subscriber and billing information, as well as real-time data in locating the number in question.

Mobile carriers are also retaining user information for months, even years, with Verizon keeping location records for "one rolling year," while "T-Mobile keeps them for 'officially 4-6 months, but really a year or more.'" Sprint holds onto them for 18-24?months and AT&T "since July 2008."

Crump told msnbc.com that the ACLU has "not aggregated the amount of money that mobile carriers have received nationally from law enforcement through the disclosure of location records. It is likely, however, that this number is substantial."

As for responses to the report, Crump said, "So far, we haven't heard of any agencies changing their standards for cellphone tracking. Although the state of the law is confused, and each police department seems to have its own standards for when and how to engage in this tracking, we're not aware of any agencies rethinking their policies in light of our inquiries. Many agencies have refused to give us any information about their use of cellphone tracking, claiming the public records laws exempt them from having to disclose this information."

That's where the ACLU differs from law enforcement, as Crump told us:

The public has the right to know under what circumstances their local police are tracking cellphones. Location information is sensitive, and can paint an intimate portrait of someone?s life. It can reveal their daily routine, and deviations from that routine. It can reveal where a person goes to the doctor, who his or her friends are, and what political or civic organizations he or she patronizes. This isn?t the sort of information law enforcement agents should be collecting without the safeguard of going to a judge and proving to that judge that there is a good reason to believe that a search will turn up evidence of a crime.

In a statement, the ACLU said it:

supports bipartisan legislation currently pending in both the House of Representatives and the Senate that would address this problem called the Geolocation Privacy and Surveillance (GPS) Act. It would require law enforcement officers to obtain a warrant to access location information from cell phones or GPS devices. It would also mandate that private telecommunications companies obtain their customers? consent before collecting location data. At least 11 state legislatures are also considering bills related to location tracking.

Much like with the re-imaginings that take place all-too often in the world of motion pictures, said game makers would have to perform a major overhaul on just about every aspect of the original ? giving their project such a giant face-lift that very little of the new title?s source material remained. Now picture that our company of video game architects ? whom we?ll just go ahead and call Starbreeze Studios from hereon in ? made the same mistake the people in Hollywood tend to make, and became so obsessed with making their title so modern and niche, that they completely neglected to make it interesting in the process.

Yes, kids, I?m sorry to say that Starbreeze Studio?s version of Bullfrog Productions? good ol? ?90s Syndicate series is a painfully dull one. Straight from the get-go, Syndicate sets out to impress you ? but its generic premise and sloppy manufacturing prevent such a thing from happening. Even the ?star? talents of Rosario Dawson, Brian Cox, and Michael Wincott (all of whom appear in the game via caricatures of themselves) don?t help any. The game begins with an introduction to the world we?re about to play in: a half-dystopian land of the future wherein mega-huge-?ber-conglomerate Eurocorp has perfected and created the ?DART chip? ? a really techie-like thingamabob that has rendered most of our current electronic devices (mobile phones, computers, etc.) outmoded.

The DART bio-chip is implanted within the heads of humans, making it easy for Starbreeze to execute a number of training levels that are too Tron-looking for my tastes. For players, however, the chips enable them to do all kinds of neat stuff, such as access various servers (except the ones at restaurants, unfortunately), unlock electronic doors, see through walls, and even ? get this ? make some of your enemies disoriented enough that they are forced to fall down dazed and confused, shoot their companions, or shoot themselves! Now, while that little piece of gameplay ? known here as ?breaching? ? might make Syndicate seem like it?s worth checking out in itself, let me assure you that it isn?t.

(Reuters) ? Prostate cancer vaccine Provenge has long incited passions unlike any other cancer therapy.

Doctors who raised doubts about it received death threats. Health regulators and lawmakers faced loud protests at their offices. A physician at the American Cancer Society was so intimidated by Provenge partisans that he yanked a skeptical discussion of it from his blog.

The vitriol dissipated in April 2010, when the U.S. Food and Drug Administration approved Provenge for advanced prostate cancer, satisfying investors in manufacturer Dendreon and patients who for years had demanded it be put on the market.

But the bell on Round Two sounded when Marie Huber, a trained scientist and former hedge-fund analyst, made it her mission in the last year to analyze what she believes are deadly flaws in the studies that led to the approval of Provenge by the FDA.

She argues that the main reason Provenge seemed to extend survival ? a crucial factor in the FDA?s decision ? was that older men in the study who did not receive Provenge died months sooner than similar patients in other studies.

She raises the possibility the ?placebo? they received was actually harmful and made Provenge, known scientifically as sipuleucel-T, look better by comparison.

As Huber gains traction, most notably with a February paper in the prestigious Journal of the National Cancer Institute, she, too, is receiving threats. One post on an investors? message board last month suggested that ?somebody smack her with a rubber hose.? An email said ?don?t think you will be unscathed in this battle you waged on Provenge.?

Provenge is Dendreon?s only product and the company?s stature with investors has waned with disappointing sales. In 2011, product revenues totaled $213.5 million, far from the $400 million Dendreon initially projected.

The company insists Huber?s analysis is flawed and that Provenge has helped thousands of men with prostate cancer.

?I?m looking forward to getting this to patients around the world,? said President and Chief Executive John Johnson.

FIRST CANCER VACCINE

Since it won FDA approval two years ago, Provenge has been Exhibit A for the idea that a patient?s immune system can control or cure cancer. The first therapeutic cancer vaccine to reach the market, Provenge tries to engineer white blood cells, part of the immune system, to vanquish prostate cancer, which killed an estimated 33,720 men in the United States last year.

Its path to approval has all the features of a heavyweight healthcare fight ? desperate patients demanding access to a promising therapy, a very expensive drug that extends life only a few months and efficacy data open to interpretation.

The FDA declined to approve the drug in 2007, when a clinical trial failed to show it slowed tumor growth. That incited protests, lawsuits and death threats against physicians on the FDA advisory panel who did not recommend approval, breaking with the 13-4 majority in favor.

?Provenge came along when we didn?t have much to offer for prostate cancer,? said Dr. Len Lichtenfeld of the ACS. ?The advocacy community was bursting at the seams for something that worked. When you have that situation, it inflames passions and that can overtake the science.?

In the pivotal trial called IMPACT, published in July 2010, but shared with the FDA months earlier, Provenge extended median survival by 4.1 months to 25.8 months from 21.7 months. That was sufficient for FDA approval. The vaccine costs $93,000 and patients also incur physician and other charges. Medicare agreed to cover Provenge last year, as have private insurers, but doctors initially balked at a long wait for reimbursement.

Huber had long been ?utterly intrigued? by Provenge and its ?huge promise of harnessing the immune system to battle cancer,? she said in an interview.

In documents JNCI requires authors to sign, she declared no financial conflicts of interest. Neither she nor her former firm nor anyone else she is connected to stands to benefit financially from her analysis, she said.

Instead, she says she is motivated to help ?vulnerable and desperate patients? ? so much so that she gave up her job, salary and health insurance. Arguing that Provenge is harming these men, she called ?the whole thing utterly horrific. The company got away with hiding data and doctors making $7,000 per prescription won?t even engage in discussion? about whether it helps their patients.

After receiving degrees in biochemistry and bioscience enterprise from Cambridge University, Huber began working as an analyst for a hedge fund in 2007. A Thomson Reuters analysis of securities filings confirmed her former firm has not held any positions in Dendreon.

LACK OF EVIDENCE

Each dose of Provenge is custom-made. A nurse or technician withdraws white blood cells from a man?s arm in a three-to-four hour procedure called leukapheresis.

The cells are shipped to a Dendreon manufacturing facility, where for two days they are incubated with a ?fusion protein:? One protein that stimulates the cells? growth and maturation and another called PAP, or prostatic acid phosphatase. PAP is an antigen that studs prostate cancer cells like antennae, pieces of it sticking out of the cells? surfaces.

Dendreon says the patients? white blood cells take up the antigen and within hours their surfaces bristle with fragments of the telltale molecule. The cells are then shipped back to the physician and infused into the patient. A full treatment includes three such procedures, two weeks apart.

Back inside the body, Dendreon claims the modified cells trigger the immune system to produce T cells that kill any cell sporting the PAP antigen ? namely, prostate cancer cells.

In principle, that should eliminate the cancer, but Provenge does not shrink either the primary tumor or metastases.

Steven Rosenberg of the National Cancer Institute, a leading tumor immunologist, says that raises doubts over whether Provenge helps patients live longer, as the IMPACT trial reported.

?We have a lot of data that supports the idea that the product works the way it was designed to,? said Dr. Mark Frohlich, Dendreon?s chief medical officer. ?We?re seeing evidence of immune-system activation. The only question is whether the T cells are killing the tumor.?

The FDA acknowledges that data supporting Provenge?s approval did not show the drug shrank tumors, but says the overall survival benefit was enough to bring it to market. Spokeswoman Rita Chapelle, citing data submitted by Dendreon, said there is a ?lack of evidence of anti-tumor activity,? the reason for which ?is unclear.?

SUSPICIONS OVER SURVIVAL BENEFIT

Huber?s analysis comes from data showing that men who received the placebo had very different survival times based on their age. Men older than 65 lived 17.3 months on placebo and 23 months with Provenge. Men younger than 65 lived 28 months after receiving placebo and 29 months after Provenge.

Other studies have shown that age generally does not affect how long a man survives with this form of prostate cancer, says Peter Iversen, a urologist and prostate-cancer surgeon at the University of Copenhagen and co-author of the paper with Huber.

Combining these findings led to the new paper?s conclusion: The four-month edge in median survival from Provenge for all patients was due to longer survival among older men who got the vaccine.

?There is no efficacy in the younger patients, the primary group where you would expect it,? said Huber.

Since the immune system weakens with age, an immune-based therapy should work better in younger men.

Some experts agree.

?If it was really a vaccine, you?d think younger men would show more response, since they are more immunocompetent,? said NCI?s Rosenberg.

On that basis, Huber and her co-authors, including two prostate-cancer specialists, argue the placebo used in the trial may have harmed the older men, cutting months off their lives and inadvertently making Provenge seem beneficial.

One way that could have occurred was through leukapheresis. That process removed about 90 percent of certain kinds of circulating white blood cells, according to calculations by immunologist Laura Haynes of the Trudeau Institute, a co-author of the JNCI paper.

The Provenge men got back about 32 percent of those cells, which had been stored at body temperature. The placebo men got back 12 percent, which had been incubated at near-freezing temperatures. Cold storage has been reported to kill ?most, if not all, of those cells,? notes the JNCI paper. Moreover, said Haynes, ?if you return dead and dying cells to older men you are likely to cause inflammation,? which can stoke the growth of cancerous cells.

Younger men were better able to replace the lost white blood cells, argued Iversen. Older men could not, resulting in early death.

?These cells are very specialized and there is research suggesting that removing them can harm older men,? he said.

Earlier this month, DynaMed, an online database used by physicians, added to its Provenge entry a note on the JNCI paper, but calls the concern ?not substantiated.? ACS?s Lichtenfeld says the analysis ?might inhibit some patients and doctors from going ahead with a very expensive drug.?

Huber says she plans to approach European regulators as they consider Dendreon?s application to approve Provenge.

Investor message boards have lit up in response to the new paper. In February, an anonymous commentator on InvestorVillage.com warned that Huber?s work was about to be published ?a few days before our earnings. Her agenda is obvious.?

IFFY STATISTICS

Critics of the new analysis argue the number of cells removed is too small to suppress the immune system. Charles Drake, an oncologist and immunologist at Johns Hopkins Sidney Kimmel Comprehensive Cancer Center, said there is no evidence the placebo men in IMPACT suffered more infections or other effects of a depleted immune system than the Provenge men.

The scientist who led IMPACT, oncologist Philip Kantoff of Dana Farber Cancer Center, said colleagues in immunology ?dismissed as nonsense the idea that leukapheresis could hurt individuals.?

He takes issue, too, with the statistics. Dividing the men by whether they are older or younger than 65, he said, is ?arbitrary? and to pick apart data retrospectively is a statistical no-no.

Dendreon?s Frohlich also criticizes the statistics: ?If you do enough of these (post-hoc analyses) then by chance alone you?d expect to get one positive finding.?

In other words, it is almost always possible to find a subset of patients who do better than others.

Some of the latter decline to use Provenge, deterred by lingering concerns over whether it provides a meaningful benefit.

Three such facilities in the Midwest, contacted at random by Reuters, confirmed they do not recommend Provenge. All asked not to be named for fear of receiving threats.

(AP) ? One of Japan's crippled nuclear reactors still has fatally high radiation levels and hardly any water to cool it, according to an internal examination Tuesday that renews doubts about the plant's stability.

A tool equipped with a tiny video camera, a thermometer, a dosimeter and a water gauge was used to assess damage inside the No. 2 reactor's containment chamber for the second time since the tsunami swept into the Fukushima Dai-ichi plant a year ago. The probe done in January failed to find the water surface and provided only images showing steam, unidentified parts and rusty metal surfaces scarred by exposure to radiation, heat and humidity.

The data collected from the probes showed the damage from the disaster was so severe, the plant operator will have to develop special equipment and technology to tolerate the harsh environment and decommission the plant, a process expected to last decades.

Tuesday's examination with an industrial endoscope detected radiation levels up to 10 times the fatal dose inside the chamber. Plant officials previously said more than half of melted fuel has breached the core and dropped to the floor of the primary containment vessel, some of it splashing against the wall or the floor.

Particles from melted fuel have probably sent radiation levels up to dangerously high 70 sieverts per hour inside the container, said Junichi Matsumoto, spokesman for Tokyo Electric Power Co.

"It's extremely high," he said, adding that an endoscope would last only 14 hours in that condition. "We have to develop equipment that can tolerate high radiation" when locating and removing melted fuel during the decommissioning.

The probe also found the containment vessel ? a beaker-shaped container enclosing the core ? had cooling water up to only 60 centimeters (2 feet) from the bottom, far below the 10 meters (yards) estimated when the government declared the plant stable in December.

Finding the water level was important to help locate damaged areas where radioactive water is escaping.

He said that the actual water level inside the chamber was way off the estimate, which had used data that turned out to be unreliable. But the results don't affect the plant's "cold shutdown status" because the water temperature was about 50 degrees Celsius (122 Fahrenheit), indicating the melted fuel is cooled.

Three Dai-ichi reactors had meltdowns, but the No. 2 reactor is the only one that has been examined because radiation levels inside the reactor building are relatively low and its container is designed with a convenient slot to send in the endoscope.

The exact conditions of the other two reactors, where hydrogen explosions damaged their buildings, are still unknown. Simulations have indicated that more fuel inside No. 1 has breached the core than the other two, but radiation at No. 3 remains the highest.

The high radiation levels inside the No. 2 reactor's chamber mean it's inaccessible to the workers, but parts of the reactor building are accessible for a few minutes at a time ? with the workers wearing full protection.

Last year's massive earthquake and a tsunami set off the worst nuclear accident since Chernobyl, sending three reactor cores to melt and causing massive radiation leaks. The government said in December that the reactors are safely cooled and the plant has stabilized, while experts have questioned its vulnerability.

During a recent visit by a group of journalists including The Associated Press, the head of the plant said it remains vulnerable to strong aftershocks and tsunami and containing contaminated water and radiation is a challenge. Radioactive water had leaked into the ocean several times already.

Workers found the fresh leak of 120 tons from a water treatment unit this week from one of its hoses, with estimated 80 liters (20 gallons) escaping into the ocean, Matsumoto said. Officials are still investigating its impact.

Fukukushima's accident has instilled public distrust and concerns about nuclear safety, making it difficult for the government to start up reactors even after regular safety checks. All but one of Japan's 54 reactors are now offline, with the last one scheduled to stop in early May.
