Former Goldman Sachs director convicted

NEW YORK (AP) ? A former Goldman Sachs director was found guilty Friday of feeding confidential information to a corrupt hedge fund manager, becoming the most prominent defendant convicted so far in a wide-ranging probe conducted by investigators armed with wiretaps.

Rajat Gupta ? born in India, educated at Harvard and well-known in corporate America ? was convicted by a jury of conspiracy and three counts of securities fraud, and acquitted of two other securities fraud counts. He showed no visible reaction as the verdict was read, though his adult daughters hugged and wept.

The trial of the 63-year-old Gupta, and the one last year for former billionaire Raj Rajaratnam, pulled back the curtain on how the two longtime friends and Wall Street titans navigated the turbulent waters of the 2008 economic meltdown.

The pair had "public sides of success," said Assistant U.S. Attorney Reed Brodsky said at closing arguments at the closely watched white-collar trial. "But concealed from the public was a different side ? a side that committed crimes."

The prosecutor argued that secret recordings of phone calls between the two men showed that Gupta was so brazen about sharing Goldman board secrets it sounded like "he was talking about what happened at a Yankee game yesterday."

Defense attorney Gary P. Naftalis countered that the FBI wiretaps, phone records and other evidence presented by the government had only created the "illusion" that legitimate business dealings were somehow sinister.

"That is a gambit that can bamboozle people into thinking something was proven when it wasn't," Naftalis told the jury. Outside court, he said he was disappointed in the guilty verdicts.

"We believe the facts of this case demonstrate that Mr. Gupta is innocent," Naftalis said. "He always acted with honesty and integrity."

"Rajat Gupta broke the law, plain and simple," FBI Assistant Director Janice K. Fedarcyk said in a statement.

Rajaratnam, founder of the $7 billion Galleon hedge fund, was sentenced last October to an 11-year prison term on an insider-trading conviction. Less than a month later, Gupta was charged in a separate case built on the some of the same wiretap and other evidence.

Allegations that Gupta conspired with a convicted white-collar criminal represented a fall from grace: The defendant is a former chief of McKinsey & Co., a highly regarded global consulting firm that zealously guards its reputation for discretion and integrity. He also is a onetime director of the huge consumer products company Procter & Gamble Co.

During the trial that began on May 20, the government highlighted a Sept. 23, 2008, phone call it said was made from Gupta to Rajaratnam. The call came only minutes after Gupta had learned during a confidential conference call about how Warren Buffett's Berkshire Hathaway planned to invest $5 billion in Goldman ? a blockbuster deal that wouldn't be announced until the stock market closed at 4 p.m.

"That news was going to be very good news for Goldman Sachs," another prosecutor, Richard Tarlowe said in closing arguments. "The average ordinary investor had no way of knowing that. ... Until the announcement, it was confidential."

Records showed that moments after the phone call ended at 3:55 p.m., Rajaratnam purchased $40 million in Goldman stock ? an 11th hour trade that ended up making him nearly $1 million.

The hedge fund manager's assistant, Caryn Eisenberg, testified at trial that it was the only call her boss received on his private line that day between 3 p.m. and 4 p.m.

"That evidence is devastating for the defendant. ... If you believe Ms. Eisenberg, it's over ? the defendant is guilty," Tarlowe said.

Also played at trial was a wiretap of a July 2008 phone call during which Rajaratnam grilled Gupta about whether the Goldman Sachs board had discussed acquiring a struggling bank, like Wachovia, or an insurance company.

"Have you heard anything along that line?" Rajaratnam asked Gupta.

"Yeah," Gupta responded. "This was a big discussion at the board meeting."

In another recorded phone call in 2008, Rajaratnam told one of his traders that he had got a tip "from someone who's on the board of Goldman Sachs" that Goldman was facing an unexpected quarterly loss.

Prosecutors argued the sequence of events ? the phone calls, the subsequent trades and Rajaratnam's boasting about his inside connection ? could not be dismissed as mere coincidence. Gupta, they said, was motivated to help Rajaratnam because he had a financial stake in some of the hedge fund manager's business ventures.

"What was good for Raj Rajaratnam was good for Mr. Gupta," Brodsky said.

Naftalis countered that most the evidence was specific to the "secret world" of Rajaratnam and not about Gupta.

"I sometimes wondered whether Raj Rajaratnam was the man on trial," he said. His client, he added, was a victim of "pure guilt by association."

Teen connected to Tualatin church fire sentenced to probation

TUALATIN, Ore. ? A judge on Monday sentenced a 13-year-old boy who was involved in a Tualatin church fire to probation and counseling for five years or less.

It was a sentence far less than his 14-year-old co-defendant who could be in juvenile custody for 11 years.

There are two reasons for the difference.

First, the boy sentenced Monday pleaded guilty to only burglary. His lawyer said the boy did not have any intention to set the Living Savior Lutheran Church on fire in March. Instead, it was only to break into the church. It was the other boy who set the fire and pleaded guilty to the more severe charge of arson.

The second difference is what the boys have done since the fire. The 13-year-old boy has followed all the rules asked of him unlike the other teen, according to the judge.

The 13-year-old will be able to stay out of custody as long as he follows his rules of probation which include (in addition to counseling) that he undergo drug testing and write a letter of apology to the church.

The fire caused more than $2 million of damage to the church. The teens broke into the church looking for money.

Church members say they want the boys to learn a lesson and not have the incident destroy their lives.

The mother of the 13-year-old said after Monday's sentencing that her son is a good kid who made a bad decision.

Both boys' families may be on the hook for some restitution to the church, depending on their liability insurance. It could be hundreds of thousands of dollars.

Coach Andy Flower hopes Ian Bell can fill Pietersen's void.

He's got a lot of international experience and he's in great form, very confident at the moment. You saw some of that form and skill yesterday (Sunday). With the two new white balls (in one-day internationals) we want great quality batsmen up front and he is one of those.?

The opening spot alongside ODI captain Alastair Cook which many players have tried before, is what Bell could make his as a permanent spot ahead of the 2015 World ICC World Cup, Flower added later, showing a lot of confidence in the batsman.

Bell has been in excellent form in tests, scoring an unbeaten 76 in his previous one against the Windies, but has failed to click in shorter formats. There will be a lot riding on him this Saturday. ?He's really good quality. We believe he can form a successful partnership with Cook. I'm really excited to see him take up that challenge,? the coach was quoted adding later.

Meanwhile, Bell had some interesting words of his own and sounded pretty confident about taking up Pietersen?s slot. He was quoted by a website saying, ?It was a real shock when I heard the news about Kev. He is his own man and makes his own decisions. Captain Alastair Cook made some comments about it giving an opportunity for someone else ? and I certainly want to get myself back into the England team in all forms of the game. I?ll be working hard to take the opportunity should it arise. There are younger players coming through but I hope I still have a shout. I have unfinished business in ODIs. In one-day cricket I?d like to nail down a position in the top three.?

MAINZ, Germany - Police in Berlin said on Friday they had identified the mysterious "Forest Boy" who turned up in the German capital nine months ago claiming to have lived in woods for several years.

Investigators said a woman in The Netherlands contacted Dutch police, saying she recognized the young man?as her 20-year old step-son who had gone missing in September. A report in Die Welt [link in German] identified the "boy" as Robin, from the Dutch municipality of Hengelo.


The woman said she saw a picture that had been issued to the international press on Wednesday by German authorities seeking clues on the mystery man?s identity.

"We are 100 percent certain that he is this 20-year-old boy, because his step-mother positively identified him," a police spokeswoman told Die Welt.

The boy, who called himself Ray, told authorities he had been living in woods until the death of his father. He said his father told him he was born June 20, 1994 -- which would have made him 17 -- but claimed not to know his last name or where he was from.??

"It turns out that the young man presented a Pinocchio story," Berlin police spokesman Michael Maass told NBC News.

"We now know that the young man turned 20 in April and was reported missing in the Netherlands by his family last September," he said.

German police were questioning the young Dutchman and evaluating whether he would need to be held legally responsible for his actions.

However, police said he had quickly adapted to city life and technology, using a laptop and cell phone with no problems. "There are many question marks," police spokesman Thomas Neuendorf said on Wednesday.

The case echoes that of the 'Piano Man', a mysterious figure who turned up at a hospital in Britain in 2005 apparently unable to speak and with no clues to his identity except a talent for playing the piano. After spending months in a psychiatric hospital he admitted he was a German man who had fled to Britain after losing his job.?
