Vatican court convicts computer technician of aiding pope's ex-butler in document leaks

VATICAN CITY - A Vatican court on Saturday convicted a Holy See computer technician of helping the former papal butler in the embarrassing leak of confidential papal documents and gave him a two-month suspended sentence.

Claudio Sciarpelletti, a 48-year-old Italian who is a computer program analyst in the Vatican's Secretariat of State, had testified earlier in the trial that he had played no role in helping to leak the documents, which later formed the core of an Italian journalist's book alleging corruption in high ranks of the Vatican bureaucracy.

Last month, Paolo Gabriele, who served Pope Benedict XVI his meals and helped him dress for ceremonies, was convicted in a separate trial for the theft of the documents from the papal apartment, and is serving an 18-month prison sentence in Vatican City.

Gabriele and Sciarpelletti are the only Vatican employees to be formally investigated in the case, which distressed the pope, embarrassed Vatican hierarchy and left many wondering about the competence of the Holy See's security apparatus.

Vatican spokesman the Rev. Federico Lombardi told reporters after the verdict that the probe into the leak "isn't closed," but gave no indication of whether any other suspects existed.

Sciarpelletti was convicted of aiding and abetting Gabriele by giving conflicting statements to Vatican investigators about an envelope found in his desk, addressed to Gabriele.

Judge Giuseppe Dalla Torre cited Sciarpelletti's long years of service at the Vatican in suspending the sentence as well as ordering that the criminal conviction not appear on his record. The judge, a layman, said the court concluded that Sciarpelletti had helped Gabriele "elude the investigations of the authorities" at Vatican.

The verdict, following an hour of deliberation, was rendered "in the name of Pope Benedict XVI," Dalla Torre said.

Sciarpelletti looked crestfallen when he heard the victim, then immediately went to embrace his wife who was in the courtroom, according to reporters that the Vatican permitted to attend the trial.

Both sides have three days to appeal. Defence lawyer, Gianluca Benedetti, indicated that he would appeal, but stopped short of giving a definite reply when asked.

Vatican investigators had found the sealed envelope addressed to "P.Gabriele" and containing documents in Sciarpelletti's office desk. Sciarpelletti's defence had seemed to be strengthened when the prosecutor himself confirmed Benedetti's assertion that the envelope held documents of "irrelevant value."

Sciarpelletti said Saturday he never opened the envelope given to him 2 1/2 years ago, and insisted that his statements given to investigators were confused because of the "moral shock" he felt after being arrested and held in a Vatican cell for a day in May.

He also said that it is difficult to remember what he did nearly three years earlier, including who gave him the documents.

"I challenge anyone to recall what he did three years earlier, even on the day of your birthday," Sciarpelletti told the court.

Also on Saturday, two Vatican security officials gave brief testimony, including the No. 2 Swiss guard commander who told the court that Sciarpelletti co-operated with investigators.

The pope's top bodyguard, Domenico Giani, didn't come to court, citing security duties involving appearances by Benedict elsewhere at the Vatican, and the judge excused him from testifying.

The usual formal atmosphere of the Vatican courtroom had a moment of brief humour, provided by Sciarpelletti. When a court employee, taking down summaries of the testimony on a laptop, complained of computer problems, Sciarpelletti offered his services, asking the judge: "Do you need a technician?"

The courtroom rippled with chuckles, but his help wasn't needed. It turned out there was a problem with a plug, which was quickly resolved.

Lombardi said it was unclear if Sciarpelletti will keep his Vatican job. The defendant was ordered to pay court costs of a few thousand dollars, he said.

A French family in wartime | Parisian Fields

Today, November 11, is the anniversary of the end of the First World War. In France the Jour de L?Armistice or le Jour du Souvenir is a day of military parades and ceremonies. But there is more to remembrance than marchpasts and bugles.

A few months ago, I bought six First World War postcards at an open-air antiques sale near the Bastille. The cards, dated 1914 to 1916, showed patriotic or sentimental images specifically created for wartime correspondence. The patriotic ones showed soldiers expressing devotion to France?s flag; the sentimental ones were of wounded men being treated by angelic (and slightly improbable-looking) nurses.

What caught my attention was that all six had been sent to the same address in Montreal: 1759 Park Avenue. Clearly, the postcards had formed part of a long-ago collection. I wish I had taken the time to search for others from the same source. However, the six I did buy provide brief glimpses of a family in wartime. I decided to find out what I could about the people who had sent and received these cards.

It took me some time to track down the address. You won?t find 1759 Park Avenue on Google Maps, because the street numbering has changed since 1915. But thanks to the Biblioth?que et archives nationales du Qu?bec, I was able to look at street maps of Montreal dating from before the First World War. I found that 1759 Park Avenue corresponds to what is today 4859 avenue du Parc. The building still stands ? a typical Montreal walk-up brick row house with lots of stairs in front.

The surname that appears on the cards is unusual ? Bernigaud. Of the six cards, one had been sent to Louise Bernigaud and the rest to Jeanne or J. Bernigaud. Having two names instead of just one made it much easier to trace the family.

Louise and Jeanne were sisters and I found the whole Bernigaud family on a genealogical website. There were seven children: Louise was the eldest, followed by Henri, Philippe, Jeanne, Jean, Marie, and Paul. Their parents were Joseph and Marie. They came from Charolles, in the department of Saone-et-Loire, part of the Burgundy region. The family had left France in 1907 to come to North America (via the United States), and by late 1914 they were living in Montreal.

I spent some time deciphering the handwriting and peering at postmarks.

The first postcard (chronologically) was sent at Christmastime in 1914, from one Yvonne Michaud to Louise Bernigaud. It was posted in Montreal and contains the brief message ?Joyeux No?l et Bon Souvenir.? There were several Yvonne Michauds in Montreal at the time. So no clues there.

The second was posted in Lyon Terreaux (one of the Lyon post offices) in July 1915 by someone called Jeannine, and was addressed to Jeanne. The sender, Jeannine, seems to have been working in a French hospital in Lyon (perhaps the H?pital Desgenettes, a military establishment).? She thanks Jeanne for taking an interest in ?her soldiers.? She mentions that her uncle is suffering from tuberculosis brought on the previous winter by the severe cold. (So many people died of tuberculosis in those days; it was one of the leading causes of death.) Her cousin Albert has been evacuated from a hospital in Perpignan. Alas, since I do not know her last name, I cannot find out any more about Jeannine.

The third postcard is also addressed to Jeanne Bernigaud from Lyon, sent in December 1915, but this time, the sender was one C. Vignal. The writer alludes to a loss in the family.

I hope 1916 brings you the happiness you wish for. I hope we see each other soon, at the end of this terrible war. I think how we were all together a year ago and that your dear departed had just received his papers. How happy he was! He had his reward and his sufferings were brief. He is watching over you and protecting you. I often think of him and of you.

At first I wondered if Jeanne Bernigaud had lost a fianc?, but as I continued my research, a different story emerged. All but one of the members of the Bernigaud family were mentioned in postwar records of various sorts. Philippe was missing.

At the French Defence Ministry website I found the record. Philippe Jean Marie Bernigaud had died at Souchez, near Vimy Ridge, on June 12, 1915, as the result of enemy action. He was 20 years old.

Canadians will immediately recognize the name ?Vimy Ridge.? So many Canadians died during a later battle there (1917) that the Canadian government erected a monument to Canadian soldiers. I have visited the memorial, and was moved by its stark shapes and extraordinary vista towards the east. It has recently been meticulously restored.

Who was the author of this message, C. Vignal? There is a clue on the card. ?We were all together a year ago.? I doubt that the entire Bernigaud family had returned to France. More likely C. Vignal had been in Canada. I found a Catherine Vignal who had come to Canada before the war with her husband Henri and had been counted in the census of 1911 there. She had been born in the early 1860s, which would make her in her early 50s at this point. A possibility, but I?m really only guessing.

Card No. 4. The message is addressed to Jeanne, written in pencil, and signed ?Michaud.? There is a loop through the word that might make it ?C. Michaud.? A relative of Yvonne Michaud? Or just another person with a fairly common last name? There is no stamp or postmark. It is dated 14 January 1916. The sender apologizes for not having written earlier, and sends good wishes for the New Year for Jeanne and her family, with the hope that the entire family would soon be reunited under one roof.

Card No. 5 is also from C. Michaud, also in pencil, and dated about a month later. Michaud has received good news of Henri (Jeanne?s older brother, who would have been about 23 then).

Neither of Michaud?s cards has a postmark. They might have been sent in a packet with other letters. Perhaps C. Michaud enclosed the card in a letter to a relative (Yvonne?) in Montreal, who delivered it by hand.

Despite the lack of a postmark, I believe they were sent from France. There is a record of Henri sailing from France to New York at the end of 1916, so I assume that he was in France when C. Michaud wrote the card and therefore that both Michaud?s cards were written from France. Was Henri also a soldier on active service? The ship?s manifest lists him as a ?clerk.? Perhaps he was a clerk in the military? I wonder why he was returning to Canada.

The tone of both messages is very formal and respectful, so I?m guessing that Michaud is a young man, and a soldier, like the ones shown in the pictures on the cards. The use of pencil suggests he may have been writing from the field. I wonder what happened to him. On the French Defence Ministry site I found records of 26 people with the last name Michaud and the initial C who had died in the Great War. Many others with the same initial and last name may have survived the war and are not counted among the records of the fallen.

The last of the six postcards is from Jeannine again. It is stamped, but the postmark is too faint to read. The message is dated May 1916. Jeannine says she is now in a small town of 6,000 souls, but hastens to reassure Jeanne that it has its own post office. She mentions that the spring weather is good and speaks of her interest in gardening and stamp collecting. Part of the message is cryptic.

I found your ?marriage proposal? very funny; the ceremony is not complicated. Sell the necklaces which you can.

Votre ? demande en mariage ? m?a bien amus?e, la c?r?monie n?est pas compliqu?e. Vendez les colliers ce que vous pourrez.

What was that all about? Jeanne might have sent her friend an amusing story about a proposal, or she might have received a proposal herself that she described in an amusing way. And selling necklaces? A mystery.

That is all. Thanks to ancestry.com, I was able to follow the Bernigaud family for a few years after the war. Jeanne returned to France, and in 1922 is living in Autun, not far from her birthplace. Her older sister Louise visited her there, but returned to Canada with their brother Henri on the S.S. Melita. Henri went into business of some sort. Jean trained as a pilot. Paul was a mechanic. Marie became a secretary and worked for the wife of an eccentric New York millionaire. Their mother, who may have been widowed by the 1920s, was living in Charenton outside Paris in 1931. But there the trail goes cold.

There is something extraordinarily compelling about these bits of paper that are still fresh and readable almost a hundred years after they were mailed. They were saved as a group, eventually they were sold, and they made their way into the hands of a dealer. They travelled from France to Canada, then they went back to France, and now I have returned them to Canada. Fragile, easily destroyed, yet somehow persisting into the 21st century, they continue to bear witness to the story of one French family in wartime.

U.S. solar panel duties could cost it China market - minister

BEIJING (Reuters) - The U.S. decision to approve steep duties on Chinese-made solar panels could cost American exporters a growing market, Chinese Commerce Minister Chen Deming said on Saturday, adding that he didn't want to see a trade war.

The U.S. International Trade Commission voted last week in favor of duties ranging from 23.75 percent to about 250 percent, ruling that a flood of cheap solar panels from China had hurt U.S.-based manufacturers. Similar cases are under way in Germany.

China has already struck back by launching an investigation into imports of solar-grade polysilicon from both the United States and South Korea, and warned of action against European polysilicon.

"If you say I bought your equipment and raw materials but now that I am shipping my products you want to pop on a 249 percent tariff, fine then, buy why should I buy any more of your raw materials or equipment?" Chen told reporters on the sidelines of the 18th Communist Party Congress that will anoint the next generation of Chinese leaders.

"That's why I say any unilateral trade action will also impact the instigator. China is developing, urbanizing, China has a lot of construction under way and will need solar products, so the U.S. is losing out on a big market in the future."

The United States imported about $3.1 billion worth of solar cells and panels from China in 2011, up from $640 million two years earlier, although both figures contain some products not covered by the ITC investigation.

SolarWorld, the largest U.S. solar-panel manufacturer, accused Chinese competitors such as Suntech Power Holdings and Trina Solar of selling solar cells and panels in the United States at unfairly low prices and receiving government subsidies.

SolarWorld's German parent, SolarWorld AG, is pressing the European Union for similar curbs on Chinese solar products.

Chen valued the solar panel manufacturing equipment bought from the United States at over 40 billion yuan ($6.41 billion), and from Germany at "billions of yuan".

Chinese firms poured into manufacturing solar panels, lured by domestic subsidies meant to encourage high-tech industry and by European and American subsidies for solar energy installation.

Profits have plummeted due to cut-throat competition among over 100 Chinese manufacturers and the drying up of overseas purchasing incentives.

Chinese households often use solar panels in rooftop water heaters but the country has yet to implement any policy to encourage domestic solar energy generation. ($1 = 6.245 yuan)

Charlie Wi takes lead at Disney in PGA Tour finale

LAKE BUENA VISTA, Fla. (AP) ? Getting off to a quick start is nothing new for Charlie Wi. The hard part is figuring out how to finish.

Wi took the 18-hole lead for the third time this year ? and the eighth time in his PGA Tour career ? by closing with back-to-back birdies Thursday for an 8-under 64 on the easier Palm Course at Disney. That gave him a one-shot lead over Camilo Villegas and Tommy Gainey in the Children's Miracle Network Hospitals Classic.

This is the 184th career start for Wi on the PGA Tour and he's still looking for his first win.

Wi atop the leaderboard was a reminder that there's more at stake in the final PGA Tour event of the year than players trying to keep their jobs. Each event is another opportunity for him to get his first win, and that's would it take for him to have a chance of getting into the top 30 on the money list to earn his first trip to the Masters.

"Top 30 is definitely a goal," Wi said. "I'm not just showing up to play. You've got to have goals. I at least want to give myself a chance."

Gainey doesn't have that opportunity. He won for the first time on tour three weeks ago at Sea Island when he closed with a 60, but he was so far down the money list that even a win at Disney wouldn't be enough for him to get into the Masters.

Even so, Gainey is on a roll. He is 17-under par in his last two rounds, courtesy of the 65 he posted on the Palm.

"My goal is just to win, anyway," he said. "The way I'm playing right now, keep hitting the golf shots and keep hitting it in the fairways, and with the way I'm rolling this putter, it's going to be good by Sunday afternoon."

Villegas was another story.

A rising star in 2008 when he won consecutive FedEx Cup playoff events and rose to No. 7 in the world, Villegas has fallen on tough times. He hasn't won since then, failed to qualify for any of the majors this year, has plunged to No. 214 in the world ranking and is at No. 150 on the money list. Only the top 125 earn their full cards for next year, and if Villegas falls out of the top 150, he'll have to go to the second stage of Q-school.

One thing that has changed is his attitude. Villegas realized he has a great job, stopped getting angry with his golf and decided to start having more fun. It appears to be working, and now the Colombian can only hope the change is not too late.

"Trust me, people remind you, 'Hey, you're 150th on the money list.' And I'm kind of like, 'Life is good. Just keep going.' If you're good at this game, if you're out, you'll be back in. Who knows? Just take it one shot at a time."

The top 12 scores came from the Palm, which played about 1.7 shots easier than the Magnolia, where the final two rounds will be played. Henrik Stenson and Charles Howell III were among five players whose 68 was the best score at Magnolia.

Brian Harman, Scott Stallings and Russell Knox, the rookie from Scotland who is outside the top 150, were at 66. Kevin Chappell, at No. 123 on the money list, overcame an early bogey and was in the group at 67.

"I feel like if you give me enough opportunities, which I've had, I've got to play well at least one week," Chappell said. "If it's the last week of the year, that's great."

Chappell is well aware of his standing on the money list, though he was doing his best to hit good shots and to try to make putts. He changed coaches this year and was making decent progress until getting a six-week break when he failed to get past the first round of the FedEx Cup playoffs.

"I got engrossed with the golf swing, and when I came back to the fall finish, I was playing golf swing. I wasn't playing golf," Chappell said.
