Monsanto insurance: USDA tells farmers to pay for avoiding troubles ...

The United State Department of Agriculture has finalized a report to address concerns from farmers who fear they?ll be next on an ever-expanding list of defendants sued by biotech giants Monsanto, but those worries aren?t about to end.

The Monsanto Company dominates more than just grow fields across the US, as evident in their stellar track record of taking small-time farmers to court and winning cases, an occurrence that Think Progress acknowledges happens roughly a dozen times a year. Time and time again, Monsanto?s patented, lab-made genetically engineered seeds are sold to one farmer, only for Mother Nature to move the crop onto neighboring fields with the help of a bit of wind. Just as often, of course, Monsanto?s team of high-paid litigators take the little guys to court, only to triumph thanks to a legal counsel that collects around $10 million a year just to take other farmers to court.

With Monsanto-led lawsuits all too common, the USDA was tasked with putting together a panel ? the Advisory Committee on Biotechnology and 21st Century Agriculture, or AC21 ? to analyze, among other items, ?What types of compensation mechanisms, if any, would be appropriate to address economic losses1 by farmers in which the value of their crops is reduced by unintended presence of genetically engineered(GE) material(s)??

The AC21 panel released their findings in a report [PDF] entitled ?Enhancing Coexistence? that was sent to the secretary of agriculture this week. In it, however, they have little to say to the farmers who are likely to be brought before a judge while Monsanto and other biotech kings come out on top.

According to the AC21 group, the best maneuver for any Monsanto foe to take right now is to simply buy insurance, suggesting that the top guns will be given the go-ahead to continue with their contested habit of near endless litigation, a practice that has a tendency to leave the little guys bankrupt and out of business ? only to be bought up by the billion-dollar Monsanto corporation after their bills can?t be paid.

?In discussions on potential compensation mechanisms,? the panel writes, ?the AC21 considered three types of potential mechanisms: (1) a compensation fund, which might be funded by technology providers, by farmers, or by the entire food and feed production chain; (2) a crop insurance-type mechanism, which would likely involve both public financing and farmer choice to purchase the insurance; and (3) a risk retention group, which would essentially be a self-insurance tool that could be purchased by those farmers at risk of economic losses (analogous to extant insurance mechanisms for industries like the trucking industry, private campgrounds, etc.).?

?The AC21 discussed potential impacts on trade relations upon adoption of any of the three potential compensation mechanisms. The entire gamut of potential views was expressed: some members felt that establishing a compensation mechanism would send a signal to purchasers of US organic and non-GE products that there are problems in how the US produces those products, some expressed the opinion that effects would be neutral, and some felt that it would be reassuring to our trading partners in GE-sensitive markets that steps are being taken to ensure containment. All members felt, however, that if a compensation mechanism were to be instituted, that attention needed to be given to potential impacts on trade.?

In their recommendations, the panel suggests, ?If the Secretary, in considering the loss data, determines that the situation warrants development of a compensation mechanism to help address such losses, the Secretary should implement such a mechanism based on a crop insurance model.?

Additionally, no real recommendations seem to be presented to farmers regularly targeted by biotech companies in court other than to invest in some solid insurance. In a statement issued Wednesday from The National Organic Coalition (NOC), the group condemns the USDA and its AC21 panel for allegedly putting little work into alleviating a big problem destroying America?s agriculturists.

?Of particular concern in the report is the recommendation that organic and non-GE conventional farmers pay for crop insurance or self-insure themselves against unwanted GE contamination,? the group writes. ?NOC strongly asserts that this proposal allows USDA and the agricultural biotechnology industry to abdicate responsibility for preventing GE contamination, while making the victim of GE pollution pay for damages resulting from transgenic contamination.

?This is a completely wrong approach to tackling the GE contamination problem,? says Liana Hoodes, NOC?s executive director. ?At the bare minimum, USDA must stop approving additional GE crops, and prevent GE contamination by mandating pollution prevention measures, as well as make transgenic polluters, including GE technology owners, pay for their contamination.?

Andrew Kimbrell, executive director at Center for Food Safety and a NOC member, adds that the AC21?s findings are an ?ill-conceived solution of penalizing the victim is fundamentally unjust and fails to address the root cause of the problem?? transgenic contamination.?

?The AC21 report takes responsibility for GE contamination prevention out of the hands of USDA and the biotech industry where it belongs and puts it squarely on the backs of organic and non-GE farmers,? Kimbrell says.

According to the lone AC21 panel member that dissented from the rest, the report as a whole does little to alleviate anything for the time being.

?Any farmer/seed grower contaminated will not want to disclose the contamination because they are illegally in possession of a patented material and could be subject to legal action for theft of intellectual property. The committee refused to ever recognize this fact,? writes Isaura Andaluz.

Weather, airport strikes loom as 43 million hit the road

As more than 43 million Americans gear up this morning for the busiest travel day of the year, inclement weather and airport strikes may put a damper on Thanksgiving travels for some.

Approximately 39 million of today's travelers are hitting the road by car and the weather may be kind for those on highways around most of the country.

Those in the Pacific Northwest will have to brace for a soggy ride, as up to 10 inches of rain fell in parts of Oregon, up to 9 inches in Washington, and 6.5 inches in Northern California. In Oregon, this was in some parts one of the top rainiest storms ever. A third storm system is moving through the West today producing more rain, but it will not be as heavy as Monday's rainfall.

Motorists along the East Coast can look forward to a smooth ride, as most of the weather looks calm from New York to Atlanta, with mild with temperatures in the 50s in the Northeast and near 70 in Georgia.

Traffic, unsurprisingly, will not be quite as breezy, with family-filled cars expected to clog roads from coast to coast.

Dense fog that rolled into the Chicago last night, combined with a light wind, clearing skies and a moist air mass is now causing traffic delays across the area.

The top five cities bracing for the worst traffic today are: New York, Washington D.C, Chicago, San Francisco, and the most tangled roads will be in Los Angeles, with holiday road trips predicted to take 33 percent longer than usual.

And that's not the only headache in Los Angeles. Airport union workers are preparing to strike this morning at LAX. The workers, who are angry over terminated union contracts and eliminated health insurance, admit they could not have picked a worse day or a busier airport.

"It's a national day about being with your family and taking care of your family, and these workers are not able to do that," Andrew Gross Gaitan of the Seiu United Service Workers West said.

Job actions are not just in California ? angry workers are picketing coast-to-coast: from Chicago's O'Hare airport... to New York's JFK to Fort Lauderdale, Florida.

For those hitting the highway today, AAA recommends leaving as early as possible, and at the latest 2 .p.m., because by 5 p.m. the roads will be jam packed. Rush hour is expected to peak two hours earlier than normal.

"With today expected to be the busiest day, and many people also working, we're expecting this evening there will be a lot of congestion," AAA spokeswoman Heather Hunter said.

There is, however a silver lining for motorists, as gas prices are down 5 cents in the last two weeks, with the national average for a gallon of regular fuel topping off at $3.41.

Report: EV Sales in China Will Fall Far Short of Government Targets

China?s government considers electric vehicle (EV) development and adoption to be a strategic priority that has major economic, environmental, and security impacts for the country, including in the areas of global climate change, energy security, urban pollution, and auto industry growth.

In fact, the government has set the goal of making China the world leader in new energy vehicle (NEV) sales. This includes a target of manufacturing 500,000 PEVs per year by 2015.

To this end, it has promoted both the new energy vehicle (NEV) (which includes hybrids and alternative fuel vehicles) and energy-saving vehicle markets throughout the past decade, laying out major investments for key NEV technology research and development (R&D), infrastructure construction, and pilot projects in more than 30 city markets.

However, according to a recent report from Pike Research, a part of Navigant?s Energy Practice, however, annual sales of PEVs will reach only 45,000 units by 2015, increasing to 152,000 vehicles in 2017. That figure represents less than 1 percent of the total light duty vehicle market in China.

Pike Research forecasts that PEV sales will fall far short of the Chinese government?s goals due to the numerous challenges involved in generating consumer interest, including the higher price premium for PEVs compared to traditional vehicles and the lack of EV charging infrastructure.

Pike predicts that BEVs will outsell PHEVs in China by a greater than five-to-one margin during the forecast period, as the incentives and consumer demand in the country favor emissions-free driving.

Since 2003, Chinese automakers have released or announced the production of 40 battery electric vehicles and 31 plug-in hybrid electric vehicles that will be on the market by 2015.? Chinese vehicle manufacturers such as BYD, SAIC, and Foton all delivered hybrids or PEVs to the market by 2011.

Among foreign automakers, Japanese and American manufacturers ? including General Motors, Honda, Nissan, and Toyota ? were early entrants to the PEV market, while European suppliers have yet to announce PEV launch plans for China.

?As of early 2012, only a few domestically produced EV models were available to China?s general public,? says research director John Gartner.? ?Indeed, evidence is emerging to suggest that Chinese EV manufacturers have yet to develop proven technology that can propel the market.? Even though it is unlikely to reach its targets, however, China?s EV ambitions will provide a huge boost to electric car development worldwide in the long run.?

Getting the agencies responsible for national security to communicate better was one of the main reasons the Department of Homeland Security was created after the Sept. 11, 2001, terrorist attacks.

But according to a recent report from the department?s inspector general, one aspect of this mission remains far from accomplished.

DHS has spent $430 million over the past nine years to provide radios tuned to a common, secure channel to 123,000 employees across the country. Problem is, no one seems to know how to use them.

Only one of 479 DHS employees surveyed by the inspector general?s office was actually able to use the common channel, according to the report. Most of those surveyed 2014 72 percent 2014 didn?t even know the common channel existed. Another 25 percent knew the channel existed but weren?t able to find it; 3 percent were able to find an older common channel, but not the current one.

The investigators also found that more than half of the radios did not have the settings for the common channel programmed into them. Only 20 percent of radios tested had all the correct settings.

The radios are supposed to help employees of Customs and Border Patrol, the Transportation Security Administration, the Coast Guard, Immigration and Customs Enforcement, the Federal Emergency Management Agency, the Secret Service, and other agencies with DHS communicate during crises, as well as normal operations.

DHS officials did not immediately respond to questions from ProPublica about what effect the radio problems could have on how the agency handles an emergency.

In a response letter to the report, Jim H. Crumpacker, the Department of Homeland Security?s liaison between the Government Accountability Office and the inspector general, wrote that DHS had made ?significant strides? in improving emergency communications since 2003. But he acknowledged that DHS ?has had some challenges in achieving Department-wide interoperable communications goals.?

The recent inspector general?s report is the latest in a string of critical assessments DHS has received on its efforts to improve communication between federal, state and local agencies. The Government Accountability Office reported in 2007 that the Department of Homeland Security had ?generally not achieved? this ?goal.

DHS has assigned a blizzard of offices and committees to oversee its radio effort since 2003, which the inspector general?s report claimed had ?hindered DHS? ability to provide effective oversight.?

Also, none of the entities ?had the authority to implement and enforce their recommendations,? the report concluded. Tanya Callender, a spokeswoman for the inspector general, said the current office overseeing the effort hadn?t been given the authority to force agencies to use the common channel or even to provide instructions for programming the radios.

The inspector general recommended DHS standardize its policies regarding radios, which DHS agreed to do. But it rejected a second recommendation that it overhaul the office overseeing the radios to give it more authority.

?DHS believes that it has already established a structure with the necessary authority to ensure? that its various agencies can communicate, Crumpacker wrote in his response letter.
