Restaurant settles over 'carcass removal' listing

HELENA, Mont. (AP) ? A phone book company has settled a lawsuit over its placement of a Montana restaurant in the "Animal Carcass Removal" section of its yellow pages, a listing the restaurant owner says cost him customers and made him the butt of a Jay Leno joke.

The terms of the Nov. 16 deal between Dex Media Inc. and Big Sky Beverage Inc., the parent company of Bar 3 Bar-B-Q, were not disclosed. A tentative agreement proposed in September said a deal would include a payment to the restaurant owner.

Restaurant owner Hunter Lacey sued Dex after the listing appeared in the 2009 phone book and was reprinted in other print and online directories in 2010 and last year. It gained national notoriety after Leno featured it as a joke on the Tonight Show in January 2011.

Lacey's lawsuit claims a Dex salesman deliberately published the free listing under the "Animal Carcass Removal" section after he refused to buy an advertisement in the phone book. The salesman no longer works for the company.

Lacey claimed the negative publicity caused business to drop off at his Bozeman and Belgrade restaurants and his brand's reputation to suffer. His lawsuit alleged negligence, defamation and slander, among other charges.

Dex has said it was an erroneous listing the company removed from its online directory when it was discovered.

The case seemed to be headed for court after it was filed in U.S. District Court in September 2011. But settlement talks began in earnest after U.S. Magistrate Judge Keith Strong denied a request to dismiss the case because of problems he saw with Dex's disclosure of company documents to Big Sky Beverage's attorney.

Strong took issue with the timing of Dex's release of audio recordings of the salesman's calls to Bar 3 Bar-B-Q and a company document without giving the other side adequate time to inspect them in preparation for questioning the salesman.

Attorneys for both sides told the judge less than two months later they had reached a tentative settlement, which was finalized this month.

Neither Lacey nor attorneys for Dex and Big Sky Beverage returned calls and emails seeking comment this week.

Report: Impunity endangers Somalia's journalists

NAIROBI, Kenya (AP) ? Somalia's journalists are urging their new government and the international community to help end the impunity they say is contributing to making Somalia one of the world's most dangerous countries to practice journalism.

So far 18 Somali journalists have been killed this year and 44 since 2007.

The National Union of Somali Journalists on Friday said that impunity has become a fundamental problem in Somalia. Journalists in almost every region of the country commonly face harassment, blackmail, arbitrary police detention and, in addition, criminals are hired to suppress them, said the group in a report to mark the International Day to End Impunity, sponsored by the free expression group, IFEX.

"Despite this, the authorities provide no support to journalists, and the perpetrators operate with impunity," the report said. Journalism in Somalia has reached a state of emergency, said the report. None of these crimes are investigated properly, much less prosecuted, despite successive administrations, the report said.

No action has ever been taken following a case of violence against a Somali journalist, the report said.

Journalists are being targeted to silence them from speaking against corruption, violence and violations of human rights by radical Islamist groups, said Somali Journalist Mohamed Bashir Hashi.

"We are on the lookout behind our backs every minute because media is getting lots of enemies in Somalia," said Hashi, a reporter with the local Shabelle radio in Somalia.

Somalia's government should implement judicial reforms that will aid free and fair trials, as well as provide judicial protection for the media and ensure that police adhere to the law, according to the report titled "Impunity: War on Somali Journalists." The international community can assist Somalia's federal government to put in place effective and functional public law and order, the report said.

Somalia has made significant strides politically this year in trying to establish its first functional government to move the country away from its failed state status.

A new interim constitution has been passed, a new parliament was seated and a new president was voted in. Somali elders were tasked with naming the parliament since no election could be held, given the state of security around the country. Parliament in turn elected a new president who named a prime minister, who announced his cabinet earlier this month.

Although Somalia has had transitional administrations since 2004, it has not had a functioning central government since 1991, when warlords overthrew a longtime dictator and turned on each other, plunging the impoverished nation into chaos. The transitional governments lacked legitimacy and were accused of corruption.

The parliament last week voted to reduce the Cabinet to 10 members, in a sign Somalia's government may be willing to move away from its corrupt past.

African Union troops have helped to push Islamist extremists called al-Shabab out of all Somalia's major cities, giving the newly elected government a chance to rebuild the country.

The International Federation of Journalist says the al-Qaida-affiliated al-Shabaab has a bloody record of maiming and killing journalists who do not toe their line.

With Hizbul-Islam, another hardline insurgent group, they have in recent years ratcheted up pressure on radio stations, first and foremost to ascertain their authority on what goes on air and, most importantly, to impose Taliban-type commandments on un-Islamic music, ringtones, film and football, said Jim Boumelha, the IFJ president.

Boumelha said September was the bloodiest month as renewed killings of journalists may have been triggered by the recent change of government.

On September 20, suicide bombers blew themselves in a restaurant in Mogadishu killing three journalists and wounding five others. The following day another journalist, Hassan Yusuf Absuge, working for Radio Maanta, was shot dead near his station, Mogadishu. Al-Shabaab claimed that their supporters did it.

"With a new speaker of parliament, a new president and a new cabinet, the Somali journalists and their union expect a new beginning and a fresh commitment to protect journalists and tackle impunity as a priority and to promote the right to free expression," he said.

As the Mexican drug cartels obtain more control in Mexico, they are able to seep across the border and grab hold of the drug market in the United States. Cartels are able to easily transport their product across America, and to some this is proof the war on drugs is failing.

?We pretend that the cartels don?t have an infrastructure in the U.S.,? Fulton Armstrong, and ex-CIA officer, told The Washington Post. ?But you don?t do a $20 billion a year business . . . with ad-hoc, part-time volunteers. You use an established infrastructure to support the markets. How come we?re not attacking that infrastructure??

The Sinaloa cartel, headed by Joaquin ?El Chapo? Guzman, one of the most wanted men in the world, dominates the drug market. They are also the same cartel that received over 2,000 guns from the ATF in Operation Fast & Furious. The drugs are shipped to Los Angeles where cartels hide the drugs in trucks with other common goods and ship them to their destinations via major highways. Popular hubs include Los Angeles, Chicago, and Atlanta, but the DEA estimates there are 1,286 cities on the distribution grid.

Pseudoephedrine laws have lead to a huge drop in American made methamphetamine, but it?s also given rise to Mexican-made meth. This is a top drug in major cities like Oklahoma City. Two times this summer the Oklahoma Bureau of Narcotics (OBN) made drug busts related to Mexican meth. Chicago DEA Agent Jack Riley said the Sinaloa cartel?s meth is more pure and ?that gives users a faster and longer-lasting high.?

Agencies manage to put dope on the table, but it hardly puts a dent in the infrastructure. The drug cartels send in new lieutenants to replace old ones. High up officials are still just pegs on the totem pole and can be easily replaced. Unless law enforcement gets to the heart of the infrastructure, the king (the supplier) will remain the king, and drugs will flow freely.

Israeli forces kill Gaza man despite cease-fire

Updated at 7:55 a.m. ET: GAZA -- A 20-year-old Palestinian was killed and 10 others injured by Israeli forces Friday, Palestinian medical officials told NBC News, despite the U.S.-brokered cease-fire declared Wednesday.

The men were shot on the Gaza side of the border as they tried to access their farmland in the eastern part of Khan Younis, the Palestinian Medical Service said early Friday.

Palestinian Foreign Minister Riad Malki said the shooting had broken the cease-fire, Reuters reported.?Malki, speaking at a meeting with Italian Foreign Minister Giulio Terzi, called the incident ?a clear violation of the agreement and should not be repeated.?

Israel's military said it had accomplished its objectives while Hamas claimed victory after the two sides exchanged deadly airstrikes and rocket attacks for over a week.

The Israeli Defense Forces imposes a no-go zone on the Gaza side of the border, but the officials said the men believed they would be able to access their farmland safely during the truce, which began late Wednesday.

A spokesman for the IDF told NBC News that it did not have any immediately information about the death of Palestinian.

The spokesman said there were several "incidents of disquiet and unrest at the Gaza border" and that "Israeli soldiers fired warning shots in the air.?

The ceasefire between Israel and Hamas had been holding firm, with scenes of joy among the ruins in Gaza on Thursday, including a celebratory rally past wrecked houses and government buildings.

However, schools stayed closed in southern Israel, where nerves were jangled by warning sirens - a false alarm, the IDF said.

Residents of Gaza return to their homes with hope the cease-fire persists. ITV's John Ray reports.

The truce was the fruit of intensive diplomacy by Egypt?s new Islamist regime, spurred by U.S. President Barack Obama, who sent Secretary of State Hillary Clinton to the Middle East.

Dogs learning to associate words with objects form these associations in different ways than humans do, according to research published November 21 in the open access journal PLOS ONE by Emile van der Zee and colleagues from the University of Lincoln, UK.

Previous studies have shown that humans between the ages of two to three typically learn to associate words with the shapes of objects, rather than their size or texture. For example, toddlers who learn what a 'ball' is and are then presented other objects with similar shapes, sizes or textures will identify a similarly-shaped object as 'ball', rather than one of the same size or texture.

Earlier research with dogs has shown that they can learn to associate words with categories of objects (such as 'toy'), but whether their learning process was the same as that of humans was unknown.

In this new study, the scientists presented Gable, a five year old Border Collie, with similar choices to see if this 'shape bias' exists in dogs. They found that after a brief training period, Gable learned to associate the name of an object with its size, identifying other objects of similar size by the same name. After a longer period of exposure to both a name and an object, the dog learned to associate a word to other objects of similar textures, but not to objects of similar shape.

According to the authors, these results suggest that dogs (or at least Gable) process and associate words with objects in qualitatively different ways than humans do. They add that this may be due to differences in how evolutionary history has shaped human and dog senses of perceiving shape, texture or size.

The bottom line: Though your dog understands the command "Fetch the ball", but he may think of the object in a very different way than you do when he hears it. As the authors explain, "Where shape matters for us, size or texture matters more for your dog. This study shows for the first time that there is a qualitative difference in word comprehension in the dog compared to word comprehension in humans."
