Police probe Australian political sex scandal (AP)

CANBERRA, Australia ? Australian police were investigating allegations Tuesday that a lawmaker misused a credit card to pay prostitutes, a political scandal that could bring down the country's fragile government.

New South Wales state police said they are looking into new evidence that government lawmaker Craig Thomson misused a trade union credit card when he was a senior union official in 2005 and 2007.

A conviction for theft or fraud would force Thomson to quit Parliament and cost Prime Minister Julia Gillard's year-old government its single-seat majority.

With opinion polls showing the government has become deeply unpopular, observers agree that the ruling Labor Party would have little hope of retaining Thomson's seat in an ensuing by-election.

Thomson has denied any wrongdoing and Gillard has publicly supported the lawmaker, who was first elected when Labor swept to power in 2007.

The allegation, first raised by a Sydney newspaper in 2009, dates back to when Thomson was national secretary of the Health Services Union. He allegedly used his union credit card to pay a Sydney brothel thousands of dollars of union money in two transactions.

Thomson has denied the allegation and claimed that an unnamed man had taken his credit card and forged his signature. Thomson also said that that man had repaid the money.

Thomson sued the newspaper's owner, Fairfax Media Publications, but dropped that court action in May.

Police have never investigated the allegations because the Health Services Union, which is aligned with Labor, has never made a complaint.

But an opposition senator, George Brandis, wrote to Police Commissioner Andrew Scipione on Monday with new evidence he said showed Thomson had committed a range of crimes, including fraud, which is punishable by 10 years in prison.

The new evidence included a statement from a forensic handwriting expert who said Thomson had probably signed one of the brothel credit card dockets in question. It also included a bundle of recently released court documents that Fairfax would have used in the defamation trial as proof of many more instances in which Thomson allegedly paid prostitutes with the same credit card.

Gillard told Parliament on Tuesday "it would be inappropriate for me to comment further" on the scandal because of the police investigation.

She denied any involvement in a decision by a Labor state branch to pay more than 90,000 Australian dollars ($94,000) toward Thomson's legal bills for settling his defamation case.

"Decisions about finances related to the New South Wales Labor Party are for the New South Wales Labor Party to make," she told Parliament.

The party won't explain the generous gift, but the opposition is convinced it was to prevent Thomson being bankrupted by his legal bills.

Under Australia's Constitution, a lawmaker must quit Parliament if he or she is bankrupt or convicted of a crime that carries a potential prison sentence of at least 12 months.

Eco-labeled seafood is not always what it seems

When you buy what looks to be a nice piece of certified sustainable fish at the supermarket, you'd like to think that's exactly what you're getting. Unfortunately, things aren't always what they seem, according to researchers who have analyzed DNA isolated from store-bought, eco-labeled Chilean sea bass and report their findings in the August 23 issue of Current Biology, a Cell Press publication.

"We found that, for fish purchased in US groceries, not all those labeled as MSC-certified Chilean sea bass are actually MSC-certified Chilean sea bass," said Peter Marko of Clemson University. MSC stands for the Marine Stewardship Council, an international organization dedicated to recognizing and rewarding sustainable fishing.

In the case of Chilean sea bass, MSC certification labels should indicate that a fish was harvested from the only recognized sustainable Chilean sea bass fishery, a population living in waters surrounding the sub-Antarctic island of South Georgia and a nearby plateau called Shag Rocks, Marko explained.

In fact, some of the fish that his team purchased turned out to be other species entirely. Of those that were Chilean sea bass, some 15 percent were genetically distinct from fish collected previously from the certified fishery. One sample carried a haplotype (defined as a combination of genetic variants in cellular components known as mitochondria) that has only been found on the other side of the globe, in the southern Indian Ocean. Other haplotypes that the researchers uncovered amongst fish marked with an MSC-certified label commonly trace to South American waters, and still others had never been recorded before in previous genetic surveys.

"The simplest explanation for this result is that other species plus Chilean sea bass from other, uncertified fisheries are being added to the supply chain for MSC-certified Chilean sea bass," Marko said. Although unexpected, "the results are not exactly shocking," given widespread mislabeling in the seafood industry and potential profits to be made.

It isn't clear who is responsible for the misleading labels, given that fish pass through many hands from the time they are caught to the time they are purchased.

"There is no question that organizations like the Marine Stewardship Council are trying their best to guide consumers to sustainably harvested seafood, but it is currently difficult to guarantee the geographic origins of fish," Marko said. He added that the MSC has been working on ways to confirm fishes' origins, and the new study may serve as a model for how to go about that.

The only thing it seems that concerned consumers can really do for now is keep Chilean sea bass off their dinner menus. "At a grocery or on a plate in a restaurant, Chilean sea bass from South Georgia looks the same as Chilean sea bass from other parts of the world," Marko said.

If you have heard about any kind of Federal financial aid for students, you are already familiar with US Department of Education loans. The US Department of Education handles all government aid for defraying the cost of attending college in America, from grants to loans. The first thing that you will need to do to apply for US Department of Education loans is to fill out a FAFSA, or Free Application for Federal Student Aid form. FAFSA forms compare the amount of money required to attend a specific college to the amount of money that can be expected to be paid by the family of the attendee. Qualifying for US Department of Education Loans
US Department of Education loans have specific qualifications that an applicant must meet to be eligible. The qualifications include US Citizenship (some non-citizens with social security numbers are also eligible), financial need, possession of a valid Social Security Number, and proof of eligibility for higher education in the form of a high school diploma, General Education Development (GED) certificate, or similar. Furthermore, applicants for US Department of Education loans must be in good financial, academic, and legal standing. In other words, they must be registered with the Selective Service if required, they must not have defaulted on a student loan in the past, they can have no record of conviction on charges of sales or possession of drugs, and they must maintain a certain grade point average (GPA) to continue to receive student loans from the Department of Education.

Types of US Department of Education Loans
There are three main possibilities when considering US Department of Education loans: grants, which are monetary gifts, student loans, and work-study programs where the money for education is earned. Only in the case of student loans
does the money need to be repaid. Most federal grants are based solely on financial need, and some are given on a first-come-first-served basis, so it is important to apply as early as possible.

Work-Study programs are not technically US Department of Education loans, but they are a federally mandated way to
receive financial aid to attend college. A number of work-study hours are specified as part of the financial aid package.

These usually involve jobs working with non-profit companies or on campus, and pay a modest salary. The money earned can be used for college tuition. True US Department of Education loans include the Perkins Loan, the Stafford Loan, and the PLUS loan for parents.

Perkins loans have a particularly low interest rate and can be paid back over a time period of as long as 10 years. There are a limited number of Perkins Loans available to each school every year. The Stafford Loan has a higher interest rate than the Perkins loan, and doesn?t necessarily offer a grace period after graduation. However, there are more Stafford loans offered by the US Department of Education every year. Stafford loans are even available to students who don?t have a pressing financial need. Stafford loans may be paid off over a period of as long as thirty years.

PLUS loans are the final type of US Department of Education loans. They are offered to parents of undergraduates, as opposed to the students themselves. Payments on Federal PLUS loans start two months after the money is received, and can be paid off over a ten-year term.

Growth of cities endangers global environment, according to new analysis

ScienceDaily (Aug. 20, 2011) ? The explosive growth of cities worldwide over the next two decades poses significant risks to people and the global environment, according to a meta-analysis published August 19 in PLoS ONE.

Researchers from Yale, Arizona State, Texas A&M and Stanford predict that by 2030 urban areas will expand by 590,000 square miles -- nearly the size of Mongolia -- to accommodate the needs of 1.47 billion more people living in urban areas.

"It is likely that these cities are going to be developed in places that are the most biologically diverse," said Karen Seto, the study's lead author and associate professor in the urban environment at the Yale School of Forestry & Environmental Studies. "They're going to be growing and expanding into forests, biological hotspots, savannas, coastlines -- sensitive and vulnerable places."

Urban areas, they found, have been expanding more rapidly along coasts. "Of all the places for cities to grow, coasts are the most vulnerable. People and infrastructure are at risk to flooding, tsunamis, hurricanes and other environmental disasters," said Seto.

The study provides the first estimate of how fast urban areas globally are growing and how fast they may grow in the future. "We know a lot about global patterns of urban population growth, but we know significantly less about how urban areas are changing," she said. "Changes in land cover associated with urbanization drive many environmental changes, from habitat loss and agricultural land conversion to changes in local and regional climate."

The researchers examined peer-reviewed studies that used satellite data to map urban growth and found that from 1970 to 2000 the world's urban footprint had grown by at least 22,400 square miles -- half the size of Ohio.

"This number is enormous, but, in actuality, urban land expansion has been far greater than what our analysis shows because we only looked at published studies that used satellite data," said Seto. "We found that 48 of the most populated urban areas have been studied using satellite data, with findings in peer-reviewed journals. This means that we're not tracking the physical expansion of more than half of the world's largest cities."

Half of urban land expansion in China is driven by a rising middle class, whereas the size of cities in India and Africa is driven primarily by population growth. "Rising incomes translate into rising demand for bigger homes and more land for urban development, which has big implications for biodiversity conservation, loss of carbon sinks and energy use."

Genetically Modified Papayas Attacked In Hawaii

HONOLULU ? The destruction of thousands of papaya trees on the Big Island has some farmers speculating it's the work of activists who are against genetically modified fruit.

Hawaii County police are investigating the vandalism, which appears to have been done with a machete. Papaya farmers are asking if they are targets of eco-terrorism because the majority of papayas grown on Oahu and the Big Island are genetically modified to make them disease resistant.

Biotechnology is credited with saving Hawaii's papaya production industry. Richard Manshardt, one of the University of Hawaii scientists who helped develop the transgenic papaya, said without the science papayas would be more expensive.

The Hawaii Papaya Industry Association has raised a $10,000 reward in the case.

On July 10, 2010, I had reported on the planned Organisation of work on the patent reform under the Polish Presidency. Now, as we still are within the summer recess period where nothing appears to move forward there might be a little stretch of time to contemplate as to how things might move on during next fall.

There is a recent precedent of successful adoption of enhanced co-operation in the EU: As we can learn from Wikipedia, with the rise in cross border?divorce in the EU, common rules were put forward to settle the issue of where trans-national couples can divorce in the EU. However?Sweden was blocking the new rules, fearing the loss of its liberal divorce law (divorce law differs strongly, with?Nordic liberalism being in contrast to more conservative countries such as?Malta which ? until recently ? did not even allow it). In order to allow those willing states to proceed without Sweden, in July 2008 nine countries put forward a proposal to use enhanced co-operation. At a meeting of the justice ministers on July 25, 2008, the nine states decided to formally seek the measure of enhanced cooperation; eight states formally requested it from the European Commission on 28 July 2008.

When analysing this narrative on the EU Council document repository, we get that there was a Council Document 9898/2/10 REV 2 titled Proposal for a Council Decision authorising enhanced cooperation in the area of the law applicable to divorce and legal separation ? Adoption dated June 04, 2010. The corresponding Council Document concerning the European patent with unitary effect appears to be No 5538/11 dated February 11, 2011 titled Council Decision authorising the creation of unitary patent protection.

On December 13, 2010, Document 17523/10 was published titled Council Regulation implementing enhanced cooperation in the area of the law applicable to divorce and legal separation. This Implementation Regulation was again amended and finally adopted by the Council.

Obviously there seems to be a two-step approach:

  • In a first step, the basic question as to whether or not utilisation of the enhanced co-operation model is politically endorsed by a sufficient EU Council majority at all must be decided (Council Decision authorising the enhanced co-operation).
  • In a second step, the details of the enhanced co-operation must be decided (Regulation of the Council [and the European Parliament, if applicable] implementing the enhanced co-operation).

In the field of EU patent law we do not yet have reached the point where the second step can be finalised. Available is Document 11328/11 titled Proposal for a Regulation of the Council and the European Parliament implementing enhanced cooperation in the area of the creation of unitary patent protection Proposal for a Council Regulation implementing enhanced cooperation in the area of unitary patent protection with regard to the applicable translation arrangements ? General Approach dated June 23, 2011. The General Approach still needs to be refined in order to reach a compromise which can be voted on in the EU Council.

Meanwhile, work on this Draft Implementation Regulation has been handed over to the somewhat ominous Friends of the Presidency Group; see my earlier posting here. Document CM 3913/11 tells us that the Friends of the Presidency Group (Patents) met on Monday, July 18, 2011 at 10h00, discussing

  • Accessibility, functionality and effectiveness of Patent Litigation System ? business perspective; and
  • Continuation of the exchange of views on the new elements of the draft agreement on a Unified Patent Court and draft Statute introduced following Opinion 1/09 of the CJEU (Document 11533/11)

The deliberations were not open to the public; the results apparently are not known so far.

Nevertheless, what I expect to see is an advanced Draft of the Implementation Regulation in the Council maybe even as early as later this year.

As far as I understand the rules of the game, consent of the European Parliament to the Implementing Regulation is required before final adoption.

I do not have any clue as to how exactly the procedural effect of two lawsuits filed by Italy and Spain with the Court of Justice of the European Union will be:

  • Document 12500/11 dated July 05, 2011, titled Case before the Court of Justice of the European Union ? Case C-274/11 (Kingdom of Spain against Council of the European Union) ? Enhanced cooperation in the area of the creation of unitary patent protection; now visible on the Curia website; and
  • Document 12502/11 dated July 05, 2011, titled Case before the Court of Justice of the European Union ? Case C-295/11 (Italy against Council of the European Union) ? Enhanced cooperation in the area of the creation of unitary patent protection; now visible on the Curia Website.

I have any idea neither as to when the Court of Justice of the European Union will take a decision on both cases nor as to whether or not final adoption of the enhanced co-operation is to be delayed until then.
